DESCRIPTION
Join the LMA and Wilson Elser for an in-depth look into the US court system and its impact on underwriters and claims practitioners.
The session will outline how underwriters evaluate risk, demonstrating the significance of location in determining the level of a risk. It will also explore why claims analysts must fully appreciate the state and venue of a claim when evaluating its value.
The session will explore:
- the US court system and how it is organised
- the impact of litigation funding on the market
- the right to a jury trial
- how the organisation of the court system leads to different laws being applied, depending on the location of the claim
- dangerous jurisdictions and strategies for getting cases in the most favourable jurisdiction
- how different venues and laws can change the outcome of a claim.
