DESCRIPTION
The LMA invites you to the Terrorism & Political Violence Panel Market Forum, where Andrew Tobin, Jacqui King and Maeve Canavan of Mills & Reeve will present on their recent important High Court win in Hamilton & Ors v Afghan Global Insurance Anham.
This is the first-ever decided case concerning a standalone political violence policy. Mills & Reeve represented successful reinsurers, saving US$41m. It concerns the Beazley 7-point wording and sets an important precedent.
Attendees can expect to gain an insight into the recent Hamilton case and an understanding of the resulting implications for insurers. The speakers will discuss:
- loss background
- range of defences raised
- jurisdiction battle between London and USA (including an anti-anti suit injunction)
- reinsurers’ application for summary judgment
- meaning of “seizure” (an excluded peril)
- whether the political violence policy responds to deprivation loss or only to actual property damage
- boundaries between political violence and political risk insurance
- possible implications for the market.
Speakers
- Andrew Tobin is a partner at Mills & Reeve, where he leads the Specialty team and specialises in international insurance and reinsurance coverage. His expertise in the insurance and exclusion of political violence has been a key focus since his work on the World Trade Center attacks. He was the principal author of the Insurance Institute of London’s 2007 textbook War Risks and Terrorism and has contributed the legal chapter to the forthcoming second edition. Throughout his career, Andrew has been involved in significant tests of political violence products, including the Thailand Riots, the Arab Spring and disturbances in Mexico, Chile, Afghanistan and many other regions.
- Jacqui King is a Principal Associate at Mills & Reeve with a broad practice covering various coverage and defence matters. She collaborates closely with Andrew Tobin on political risk, credit and political violence cases and has a particular interest in cyber insurance.
- Maeve Canavan is an associate at Mills & Reeve, involved in a broad range of coverage and defence work. As a member of the Specialty team, she works alongside Andrew Tobin and Jacqui King, focusing on political risks, credit and political violence.
