DESCRIPTION
The LMA invites you to Abuse Claims in Canada: Surging Damage Awards and New Coverage Issues. This fast-paced 60-minute presentation will address the explosion in abuse cases filed in Canada as statutory limitation periods are abolished and legacy claims can move forward. Attendees can enjoy a buffet lunch outside the Old Library from 12.30 to 13.00, providing an opportunity to chat with the speakers and others in the Lloyd’s market.
The presentation will be divided into two 30-minute sessions: an examination of how damage awards are trending in Canada on a province-by-province basis and, importantly, whether you can certify a class action for abuse if the range of improper conduct varies dramatically from victim to victim.
The remaining 30 minutes will be equally divided, focusing on both new decisions involving coverage for institutional abuse claims on historical policies and, more importantly, the hot issues emerging on the purpose-built sexual molestation coverages the London market is offering to Canadian risks.
